Terms of service

1. Acceptance

By accessing or using the waven.ai service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance of the revised Terms.

2. Your account

You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service. You must provide accurate, current information and are responsible for all activity under your account. You must keep your API keys confidential and notify us immediately of any unauthorized access.

We reserve the right to suspend or terminate accounts that violate these terms and to cooperate with law-enforcement requests where legally required.

4. Voice cloning & biometric data

If you upload a reference voice to clone, you represent and warrant that either the voice is your own, or you have obtained the express written consent of the voice owner for this use. You must retain proof of such consent for the duration of your use plus two years. We may request proof of consent at any time. Content found to violate this clause will be removed and the originating account may be terminated.

Biometric data. Voice recordings may qualify as biometric information under the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), Washington HB 1493, and comparable laws. By uploading a reference voice, you affirm that you have given or obtained the written release required by those laws from every living person whose voice appears in the recording. See the Biometric Information Notice in our Privacy Policy for the retention schedule.

Indemnity. You agree to indemnify and hold us harmless from any claim arising from voice material you upload, including claims under BIPA, CUBI, the Tennessee ELVIS Act, California Civil Code §§3344/3344.1 (AB 2602 and AB 1836), the right of publicity, or similar statutes.

You may not use the Service to:

If you deploy Service outputs as part of an AI system that interacts with natural persons (e.g. voice agents, interactive voice response, automated callers), you must clearly disclose to those persons that they are interacting with AI unless it is obvious from context. For AI-generated audio distributed publicly, you must clearly label the content as AI-generated. We may apply machine-readable markers (watermarks or C2PA Content Credentials) to Service outputs to support these obligations.

5. Ownership and licensing

You retain ownership of the text and reference audio you submit. Generated audio is delivered under the license of the selected model — see our credits page for each model's license and attribution requirements. We do not claim ownership of your generated audio.

Model-training posture. By default, we do not use your inputs (text, reference audio, transcribed audio) or Service outputs to train or improve our models. Where model-training involvement is offered (e.g. a free-tier opt-in), it will be surfaced in-product and may be disabled at any time in your account settings.

6. Billing and payments

Paid subscriptions are charged through Stripe and renew automatically at the end of each billing period (monthly or annually, as selected at sign-up) at the then-current rate for your plan. Your card on file will be charged each period until you cancel. You can cancel at any time from the billing portal in your account; cancellation takes effect at the end of the then-current billing period, and you will not be charged again after cancellation. Cancellation online is available and is no more difficult than sign-up.

California residents (Automatic Renewal Law). In compliance with California Business & Professions Code §§17600–17606, we will send you a renewal reminder before each material change to the subscription (including a price increase) and before annual renewals. To cancel, use the "Cancel subscription" control in the billing portal or email our support team from the address on file. If a payment fails, your account may be downgraded to the free tier after a 7-day grace period. Refunds are handled on a case-by-case basis — contact support within 14 days of the charge.

7. Service availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance. We are not liable for downtime, data loss, or service interruptions beyond our reasonable control.

8. Limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" without warranty of any kind. Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

We may suspend or terminate service for breach of these Terms, for non-payment, or for legal reasons. You may delete your account at any time. Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

10. Governing law and venue

These Terms are governed by the laws of the State of California, United States of America, without regard to conflict-of-law principles. You and we agree that the exclusive venue for any dispute arising out of or relating to these Terms or the Service shall be the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts. If any provision of this section is held unenforceable, the remaining provisions will continue in full effect.

If you are a California resident, see the Privacy Policy for a description of your rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know, delete, correct, and limit our use of sensitive personal information. We do not "sell" or "share" personal information as those terms are defined by the CCPA.
